Terms of use

These terms are an agreement between you and 1001569350 Ontario Inc. ("we", "us"), the company that runs MyAllergyCheck at myallergycheck.com and in the MyAllergyCheck apps (together, "the service"). By using the service you agree to these terms. If you do not agree, do not use it.

1. What the service does

The service compares ingredient lists with an avoid list that you enter, and shows what it found and why. It also offers a list of products that their makers market for sensitive skin. Your first check needs no account. After that, a free account is needed to keep your results and to check more products. The service is free at this time. We may add paid plans later, and we will show the price and terms before you are charged anything.

2. Your account

You sign in with a code sent to your email address, so keep access to that email secure and do not share your codes. You are responsible for what is done through your account. Give us an email address that is yours. You can delete your account at any time on the Account page, which removes your saved information as described in the Privacy policy.

If you ask for the newsletter when you sign up, we email it to you until you turn it off on the Account page or with the unsubscribe link in any issue.

3. Information only, not medical advice

The service gives general information only. It is not medical advice, not a medical device and not a substitute for a doctor, allergist, dermatologist, pharmacist or other qualified healthcare professional. It does not diagnose, treat, cure or prevent any condition. The Medical disclaimer is part of these terms. Read it.

Always read the label on the product in your hand, and ask a healthcare professional before relying on any result. In an emergency, call 911 or your local emergency number.

4. No promise of accuracy

Results can be incomplete, out of date or wrong. Ingredient lists change and can differ by country, size or version of a product; product databases contain errors; photos can be misread; and our ingredient data is incomplete and has not been clinically reviewed. A result of "No conflicts found" means only that none of the items on your avoid list were found in the ingredient list as it was read. It is not a statement that a product is suitable for you, hypoallergenic, or unable to cause a reaction.

Products in our product list are candidates chosen from how their makers market them. We have not verified their current formulas, and being listed is not a recommendation, a certification or a statement that a product is right for you.

5. Your responsibility

You are responsible for your avoid list, for checking the product label yourself, and for every decision about what you buy and use. If you use the service for someone else, such as a child, you confirm that you are allowed to do so and you are responsible for those decisions too.

6. Who can use it

You must be old enough to agree to these terms where you live (18 or 19 in most Canadian provinces), or use the service with the permission and supervision of a parent or guardian. The service is not directed at children under 13.

7. Acceptable use

You may use the service for your own personal, non-commercial purposes. You may not:

  • copy, scrape, harvest or download our ingredient data, product list or pages in bulk, by hand or with automated tools, or mirror them elsewhere;
  • use our data or pages to build or improve a competing database, product or service, or to train machine-learning models, without our written permission;
  • get around, switch off or overload the limits and protections of the service, including sending limits and the check that you are a person;
  • take apart or reverse engineer the service, except where the law gives you that right regardless of these terms;
  • use the service to break the law, to harm others, or to send spam or abuse through its forms;
  • present its results to others as medical advice.

Ordinary search engines may index our public pages as our robots file allows. Nothing here limits rights the law gives you that cannot be waived.

8. Other companies' data, names and links

Barcode lookups use Open Beauty Facts, an open database made by its contributors and offered under the Open Database License. We do not control it and are not responsible for its content. Product and brand names belong to their owners and are shown only to identify products. We are not affiliated with, or endorsed by, any brand or retailer.

Some links lead to retailers and other sites we do not run. We are not responsible for their content, products, prices or practices, and what you buy there is between you and the seller.

9. Paid links and our independence

Some retailer links are paid (affiliate) links: we may earn a commission if you buy through them, at no extra cost to you. We mark them. Commissions, brands, retailers and advertisers never change an ingredient check, a Conflict or Caution, or which warnings you see. See the Affiliate disclosure.

10. Our content

The MyAllergyCheck name, design, text, software, ingredient data and product list belong to us or to those who license them to us. These terms give you permission to use the service, not ownership of any of it.

11. What you send us

Your avoid list and history remain yours; we use them only to provide the service to you. If you send us feedback, a correction or a suggestion, you allow us to use it to improve the service without owing you anything.

12. Copyright complaints

If you believe something on the service infringes your copyright, write to us through the Contact page or by email () with: what work is yours, where the material appears on the service, your name and contact details, and a statement that you are the owner or act for the owner. We will review it and remove or correct material where the complaint is valid.

13. Suspension and termination

You can stop using the service and delete your account at any time. We may suspend or close an account, or block access, without notice if these terms are broken, if the service is misused, if the law requires it, or to protect the service or other people. Where it is reasonable, we will tell you why. If your account is closed, your saved information is deleted as described in the Privacy policy. Sections that by their nature should continue (including the disclaimers, the limit of liability and the governing law) continue after your use ends.

14. No warranties

The service is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties or conditions of any kind, express or implied, including that the service is accurate, complete, reliable, fit for a particular purpose, or always available.

15. Limit of liability

To the fullest extent the law allows, 1001569350 Ontario Inc., its directors, officers, employees and contractors are not liable for any indirect, incidental, special or consequential loss, or for any personal injury, allergic reaction, illness, property damage or other harm, arising from your use of the service, your reliance on any result, or any product you buy or use. If we are found liable despite this, our total liability for all claims is limited to the greater of the amount you paid us in the 12 months before the claim and 50 Canadian dollars.

Some laws do not allow certain warranties to be excluded or liability to be limited. Where those laws apply to you, including consumer protection laws, these limits apply only as far as the law allows, and your rights under those laws are not affected.

16. You agree to cover claims caused by misuse

If someone makes a claim against us because you broke these terms or misused the service, you agree to cover our reasonable losses and costs, as far as the law allows.

17. Changes

We may change, pause or end the service, or change these terms, at any time. The date at the top shows the latest version, and we show the notice again when a change matters. If you keep using the service after a change, you accept the new terms.

18. Governing law

These terms are governed by the laws of the Province of Ontario and the laws of Canada that apply there. Disputes go to the courts of Ontario, unless the consumer protection law where you live gives you the right to bring them elsewhere.

19. General

If part of these terms is found unenforceable, the rest stays in effect. If we do not enforce a term, that is not a waiver of it.
